Terms of Service

1. Introduction

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and ATPL Training ("we," "us," or "the Company"), governing your access to and use of:

• the website at atpltraining.io and its subdomain app.atpltraining.io (collectively, the "Website"); and
• the ATPL Training iOS mobile application, available on the Apple App Store (the "App"),

together referred to as the "Platform."

By creating an account, subscribing to a paid plan, or otherwise accessing the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Eligibility

By using the Platform, you represent and warrant that:

• You are at least 16 years of age, or the age of digital consent in your jurisdiction;
• You have the legal capacity to enter into a binding contract;
• You are not located in a jurisdiction subject to EU, UN, UK, or US trade sanctions or embargoes; and
• Your use of the Platform does not violate any applicable law or regulation.

3. Account Registration & Security

You must register an account to access most features of the Platform. You agree to:

• Provide accurate, current, and complete registration information;
• Maintain and promptly update your account information as necessary;
• Keep your authentication credentials confidential and not share them with any third party;
• Notify us immediately of any unauthorised use of your account at info@atpltraining.io.

You are solely responsible for all activities that occur under your account. Account sharing and credential sharing are strictly prohibited and may result in immediate suspension or termination without refund.

4. Description of Services

ATPL Training provides an online educational platform designed to assist student pilots in preparing for EASA Airline Transport Pilot Licence (ATPL) theoretical knowledge examinations. The Platform includes:

• A question bank of EASA-style multiple-choice questions across all ATPL subjects;
• A learning management system (LMS) with structured theory lessons;
• Timed mock examinations simulating real EASA exam conditions;
• Spaced-repetition review (FSRS) for long-term knowledge retention;
• AI-powered explanations and tutoring;
• Aviation calculation tools (E6B, mass & balance, unit converter);
• Performance analytics and pass-readiness tracking.

The features available to you depend on your subscription tier (Free, Basic, or Premium). Tier-specific entitlements are described on our Pricing page.

No Guarantee of Examination Results. The Platform is an educational tool. We do not warrant or guarantee that your use of the Platform will result in passing any EASA, national aviation authority, or other examination. Your examination outcome depends on numerous factors including your own effort, aptitude, and examination conditions, over which we have no control.

5. Subscriptions, Payments & Refunds

5.1 Subscription Plans

We offer a Free tier with limited access and paid subscription plans (Basic and Premium) with expanded access. Current pricing is displayed on our Pricing page and is subject to change as described below.

5.2 Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually) depending on the billing cycle you select at the time of purchase. By subscribing to a paid plan, you authorise us to charge the payment method you provide on each renewal date until you cancel.

Web (Stripe): Payments processed by Stripe, Inc. Your payment method is stored by Stripe, not by us.

iOS App (Apple In-App Purchase): Payments are processed by Apple and are governed by Apple's payment terms. Subscription management (renewal, cancellation, refund requests) is handled through your Apple ID account settings.

5.3 Price Changes

We reserve the right to modify our pricing. For existing subscribers, we will provide at least thirty (30) days' notice before any price change takes effect on your next renewal date. Your continued use after the price change constitutes acceptance of the new price.

5.4 Refunds

Web Subscriptions (Stripe): Payments are generally non-refundable. If you believe you were charged in error, or if exceptional circumstances apply, please contact us at info@atpltraining.io within fourteen (14) days of the charge.

iOS Subscriptions (Apple IAP): Refund requests for purchases made through the App are handled by Apple. You may request a refund via reportaproblem.apple.com. Apple's refund decisions are final and are not controlled by us.

Nothing in this section affects your statutory rights under applicable consumer protection law, including the 14-day right of withdrawal for EU/EEA consumers under Directive 2011/83/EU (note: digital content consumed immediately may be exempt from withdrawal rights once access has been granted).

6. Free Tier & Trial

Our Free tier provides limited access to the Platform at no charge and does not require a payment method. If we offer a time-limited free trial of a paid plan in the future, you will be required to provide a valid payment method. Unless you cancel before the trial period ends, your payment method will be charged at the then-current subscription price. You may cancel at any time before the trial expires without charge.

7. Acceptable Use & User Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation;
• Share your account credentials with any other person or allow multiple individuals to access the Platform through a single account;
• Attempt to reverse-engineer, decompile, or extract the source code of the Platform, its question database, or any proprietary algorithms;
• Scrape, harvest, or otherwise extract data from the Platform by automated means without our prior written consent;
• Upload or transmit viruses, malware, or any harmful code;
• Interfere with or disrupt the Platform or servers;
• Use the Platform to develop a competing product or service;
• Engage in any activity that imposes an unreasonable or disproportionately large load on our infrastructure.

We reserve the right to suspend or terminate your access without prior notice if we reasonably believe you have violated these provisions.

8. Intellectual Property

All content, materials, and software available on the Platform — including but not limited to question text, answer explanations, diagrams, lesson content, graphics, logos, trademarks, and the underlying source code — are the exclusive property of ATPL Training or its licensors and are protected by applicable intellectual property laws, including copyright, trademark, and database rights.

You are granted a limited, non-exclusive, non-transferable, revocable licence to:

• Access and use the Platform for your personal, non-commercial educational purposes; and
• View and interact with the content solely through the interfaces we provide.

You may not:

• Reproduce, distribute, modify, create derivative works of, publicly display, or publicly perform any Platform content;
• Remove, alter, or obscure any copyright, trademark, or proprietary notices;
• Sell, licence, rent, or otherwise commercialise any portion of the Platform or its content;
• Use any data mining, robots, or similar data-gathering or extraction methods.

9. Third-Party Services & Links

The Platform may integrate with or link to third-party services (including Stripe, Apple, Supabase, RevenueCat, and OpenRouter). We do not endorse and are not responsible for the content, privacy practices, or terms of such third-party services. Your use of third-party services is governed by their respective terms and policies.

10. Termination

By You. You may terminate your account at any time:

• Web: Account → Danger Zone → Delete Account (30-day grace period, cancellable by logging in).
• iOS App: Account → Danger Zone → Delete Account (immediate, as required by Apple App Store Guidelines).

By Us. We may suspend or terminate your account and access to the Platform, with or without notice, if:

• You breach these Terms;
• Your conduct creates risk or potential legal exposure for us;
• You fail to make timely payment (paid plans only); or
• We discontinue the Platform or a material portion thereof (with reasonable notice where practicable).

Upon termination, your right to access the Platform ceases immediately. We will delete your personal data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination will survive, including Sections 8 (IP), 11 (Disclaimers), 12 (Liability), and 13 (Governing Law).

11. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

• The Platform will be uninterrupted, timely, secure, or error-free;
• The content (including questions and answers) is accurate, complete, or current;
• The Platform will meet your specific requirements or examination preparation needs;
• Any errors or defects will be corrected.

EASA syllabi and examination content are subject to change. While we make reasonable efforts to keep our content aligned with the current EASA syllabus, we cannot guarantee that every question reflects the version administered on your examination date.

12. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall ATPL Training, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or examination failure, whether in an action in contract, tort (including negligence), or otherwise, arising out of or in connection with your use of the Platform.

Our total aggregate liability for any claims arising under these Terms shall not exceed the greater of: (a) the total amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred Euros (€100.00).

The limitations in this section do not apply to liability arising from fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited by applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless ATPL Training and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) your violation of any applicable law or regulation.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles.

For consumers residing in the European Union, you may also benefit from the mandatory consumer protection provisions of your country of residence. Nothing in these Terms limits your right to bring proceedings in the courts of your place of residence.

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia, except where mandatory law provides otherwise.

15. Dispute Resolution

Before initiating formal proceedings, we encourage you to contact us at info@atpltraining.io so that we may attempt to resolve the dispute informally.

EU residents may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to you via email (to the address associated with your account) or through a prominent notice on the Platform at least thirty (30) days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using the Platform and may terminate your account.

17. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ATPL Training regarding the Platform.

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment. You may not assign or transfer any rights under these Terms without our prior written consent. We may assign these Terms without restriction.

Force Majeure. We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, pandemic, war, terrorism, civil unrest, government action, internet or power outages, or third-party service failures.
